Important Note: The information you are about to provide will be treated as an anonymous official police report regarding any suspicious activity that you are wanting to report.  Once this tip is completed, it will immediately be sent to the school's Principal, the School SRO, the LCS Safety and Security office, local Law Enforcement as well other emergency response agencies as deemed necessary.  These reports will result in an immediate response from all of the people listed here as deemed appropriate based on the information submitted and may result in police involvement.

FALSE REPORT OF A CRIME - FLORIDA

DEFINITION and PENALTIES

In Florida, False Report of a Crime, or ‘False Police Report,’ occurs where a person makes a willful allegation to law enforcement regarding the commission of a crime, while knowing that no such crime has occurred. The offense carries misdemeanor penalties, including up to 1 year in jail.

DEFINITION OF FALSE REPORT OF A CRIME

The definition of False Report of a Crime, or ‘False Police Report,’ is contained in Section 817.49, Florida Statutes. Under the law, it is a criminal offense for a person to willfully and knowingly give false information or make a false report regarding the commission of a crime that the person knows did not actually occur.

False Report of the Commission of a Crime is distinguished from the offense of Giving False Information to Police in that, under Section 817.49, a person reports a crime that they know did not actually take place.

PENALTIES FOR FALSE REPORT OF A CRIME

False Police Report / False Report of a Crime is classified as a first-degree misdemeanor. As such, the offense carries penalties of up to 1 year in jail or 12 months of probation, and a $1,000.00 fine.

DEFINITION and PENALTIES

In Florida, it is a criminal offense for a person to knowingly give false information to law enforcement concerning the commission of a crime. The offense may carry misdemeanor or felony penalties, depending on the number of prior convictions and the subject matter of the information given.

DEFINITION OF GIVING FALSE INFORMATION

Under Section 837.05, Florida Statutes, it is a criminal offense for a person to knowingly give to a law enforcement or police officer false information regarding the commission of a crime.

This offense is commonly confused with False Report of a Crime, which applies where the reported crime did not actually occur. In a prosecution for Giving False Information (‘lying to police’), a crime actually occurs, but the accused knowingly gives false information concerning the incident

PENALTIES FOR GIVING FALSE INFORMATION TO POLICE

In Florida, Giving False Information to Law Enforcement under Section 837.05 may carry misdemeanor or felony penalties, depending on the number of prior convictions and the subject matter of the information.

  • First Offense (Information Concerning Non-capital Felony)- where the information communicated does not concern a capital felony, a first offense for False Information is a first degree misdemeanor, with penalties of up to 1 year in jail or 12 months of probation, and a $1,000 fine.
  • Second Offense- a second offense for False Information is classified as a third degree felony, with penalties of up to 5 years in prison or 5 years of probation, and a $5,000 fine;
  • False Information Concerning a Capital Felony- classified as a third degree felony, with penalties of up to 5 years in prison or 5 years of probation, and a $5,000 fine.
